Terms of Service - NON COMMERCIAL USE
Are you interested in commissioning me? I love you already! :3By commissioning me, you automatically agree to my terms of service listed below:GENERAL TERMSI DO NOT authorize my artwork to be used as a NFT, nor in its entirety or partially.I DO NOT authorize my artwork to be used to train AI (artificial intelligence) in any way, nor entirely or partially.**This Terms of Service applies only for PERSONAL USE. If you'd like the Commercial Use Terms of Service, click HERE• All drawings will include a subtle signature and / or watermark that you may not remove. The drawings shall NOT be modified without my, the artist, consent.• Prices are subject to change based on demand.• I have the right to reject any order that I do not feel comfortable drawing for any reason.• You MUST BE 18 years of age or older to request a commission.• Please consider that I might be in a different timezone than yours and I might take some time to answer. (GMT - 3).WHAT DO YOU GET?• Sketch and/or final sketches that you must accept before I continue the work. These will be watermarked.• Full-resolution files(300dpi PNG and 90dpi JPG) of final drawing with my signature or watermark. I will supply you with both JPG and PNG files.PROCESS & DELIVERY
• I will notify you when I have started on your commission and you, therefore, lose the rights to a refund (see further below for more info on refunds)• Each commission (unless it is a complex piece) work includes 2 chances for revision prior to the final copy, so PLEASE be specific with what you want! I will send you three thumbnail sketches (if you don’t approve any of them, I can make three more, based on critique and description - if you have visual references for what you would like, please send them too - after these six thumbnail sketches, if you still want some more thumbnail sketches, an additional $20 fee will be charged for 3 additional thumbnail sketches), I will send two WIPs - one at a more refined sketch phase (major drawing changes), limited to ONE major redrawing of the sketch, and the other at the flat colors phase (major color changes) - which you should analyze carefully and give your feedback.• Each revision after that will cost you extra 25% of your whole piece.• If you wish for me to change something in the drawing you have previously approved, I will charge you an extra fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.• If your reference is unclear to start with, any changes (after the first free one) will come at an additional charge.• During the review / revision, you will see work-in-progress and these images will usually include a watermark.• The time it takes to finish your commission can vary from 3 days – 4 weeks depending on factors such as the complexity of the commissioned piece, the time it takes to go back and forth with revisions, and other work. There is a possibility, although rare, when I will have to pause your commission due to health issues or other emergencies. When / if this happens, I will let you know as soon as possible. Additionally, I will try to give you an estimate of the remaining time it will take to finish it.• Should there be any reason I cannot finish a piece, I will offer you the work that I have done for the price it would amount to with a refund for the remainder of the cost of work not completed.• Currently, I am not accepting RUSH JOBS. If you’re thinking of commissioning me for a certain occasion or Holiday, please request a quote from me at least 2 weeks in advance. This will allow me to answer your questions and discuss details in a timely manner.• If anything comes up that will slow the progress of the initially estimated delivery time I will let you know as soon as possible.• Once the piece is finished you will receive the full-resolution image, PNG and JPG. Note that there is no physical product.• Final files will be sent through WeTransfer link, which will be available for download for a week after the link is sent. It is responsibility of the client to download and keep a backup of the final piece.PAYMENTPayment is made full upfront and processed via Stripe or PayPal invoice. If you have commissioned me through the Artistree platform, the payment is processed through PayPal as well. I will send a invoice with description of the work. If it is a higher value, payment plan is considered.The invoice will be available for you to pay for 24h. In case the payment is not made in such time period without a reason, I will cancel your invoice and move on with my queue list.Final files will not be delivered until full payment in case of a payment plan.REFUND / CANCELLATION POLICY
• The buyer is not allowed a refund once I start working on the commission.• If for any reason I am unable to start your commission you will receive a full refund.• If you cancel your order before I start it, you can get a full refund.• If you are getting a refund, do not request a PayPal charge-back. I will transfer the money back to you myself.• If you request a PayPal charge-back at any point when you were not allowed to ask for a refund you will lose all before-mentioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the charge-back and supply PayPal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted from commissioning me in the future.• If the buyer breaks any of the points stated above they will lose all the before-mentioned rights to the artwork commissioned by me, Wolfyna (the artist), and I will have the right to profit further from the commissioned artwork in any way I see fit.REVISIONS
• A fee of at least 25% will be added if you want something changed on the final drawing – unless, of course, a misunderstanding from my side has been made.COPYRIGHT / USAGE POLICY
• I, Wolfyna (the artist) claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:
◦ Promote myself with it anywhere
◦ Publish books with it (artbooks, etc.)
◦ Display it everywhere to my liking (website, social media, etc.)
◦ Post it wherever I want
• The buyer is allowed to:
◦ Use the commissioned piece for personal use unless agreed otherwise (you can upload it on all your social media profiles, forums, etc.)
◦ Print the artwork and claim the character(s) as their own, but not the artwork itself.
◦ Use the artwork to promote themselves. Crediting me as the artist is very appreciated as it helps me gain exposure!
• The following is considered copyright infringement:
◦ Reproducing/using the copyrighted artwork commercially – means making money off it in any way. Please see the Commissions Terms of Service – Commercial Use page if you want something done commercially and own the rights to the artwork.
◦ Claiming the artwork as your own
◦ Removing my signature from the artwork
◦ Altering the artwork without my consent

◦ You intend to reproduce this artwork and make money off of it. Not just for appreciation and to hang on your wall in your home.
▪ e.g. Putting my artwork(s) on t-shirts, mugs, turning it into a sticker, and other items you will mass produce
▪ Making the artwork as part of your brand• All drawings will include a subtle signature and / or watermark that you may not remove. This applies to sketches or drawings I send to you for approval, NOT the final copy. The final copy will not have my watermark or signature. If you wish, I can also send you a smaller image file for web uploads (you must specifically request this). If you want a specific size, you MUST include this in your request.• You won’t get the original files with all the layers, if you need it, you MUST include this in your request, as it will cost extra.PROCESS & DELIVERY

• After the full payment has been made and the client receives the final files of the artwork, the buyer now claims the license and rights to the produced drawing. Therefore you are allowed to use the copyrighted artwork to:
◦ Promote yourself with it anywhere
◦ Publish books with it (artbooks, etc.)
◦ Display it everywhere to your liking (website, social media, etc.)
◦ Post it wherever you want
◦ Make profit using this product and promote yourself. Crediting me as the artist is very appreciated as it helps me gain exposure!• As the artist of the commissioned work, I, Wolfyna, have the right to post the work on my website as a portfolio piece unless specified, in that case, please include it in your briefing.In case you have additional questions/requests, please feel free to contact me through my e-mail: [email protected] or any direct messages you feel the most comfortable with on any social media that I possess.
